HOUSE MASTER TERMS OF USE

This agreement governs the provision of services by House Master Company Ltd to you. The terms “You” and “Your” refer to the person that obtains, uses or otherwise accesses the Services. By using House master’s web site, You agree to be bound by these terms as updated from time to time. If you do not agree to these terms, please don’t use this resource.

 

1. SERVICES

1.1  HouseMaster provides you with the functionality and platform to enable you to list your properties for sale or lease on the website located at www.Housemaster.house  . Please note that the features and functionality that may be available as part of the Services or that are available on the website may be different depending on the device or application used to access the services or the Website (e.g. desktop vs. mobile).

1.2 Services provided by House Master does not include: (a) back up services; (b) customization; (c) training; (d) attendance at your premises; (e) correction of errors or defects, including those caused by: (i) faulty equipment or hardware provided by you; or (ii) your negligent acts or omissions and any events beyond house master’s reasonable control.

 

2.GENERAL TERMS

2.1 These terms and conditions (as amended from time to time) contain the entire agreement between you and House Master relating to the subject matter covered and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, between you and House Master in relation to such matters. No oral explanation or information given by either of us shall alter the interpretation of these conditions.  

2.2 Each provision of this agreement shall be construed as separately applying and surviving even if for any reason one or other those provisions is held to be inapplicable or unenforceable in any circumstances.

2.3 Either party has the right to terminate this agreement at any time. Termination of this agreement should be done in writing or by email.

 

3.SPECIFIC TERMS RELATING TO LISTINGS

In using the Service, you must:

  1. Only list properties which are presently available for sale or lease and which you have been authorized to market for sale or lease;
  2. Not include any promotional web addresses or other promotional material that is not directly related to your listing and your services to lease and sell the property that is the subject of that listing;
  3. Ensure that any submitted materials in respect of a property, accurately represents the property in question and is free from borders, and watermarks (unless otherwise allowed as an exception by House Master);
  4. Ensure the submitted materials are provided in the form required by House Master from time to time and contain the correct property and do not contain any information which you would not otherwise be permitted to publish through House Master.
  5. Accurately indicate the location of the property being listed;
  6. Only list each property for sale once on the service;                      

3.1 House Master will not to the full extent as permitted by law, be liable for error, misplacement, amendment, omission or failure to publish any listing.

3.2 You justify that all submitted materials, whether for the purpose of publication or not;

  1.  is accurate and complies with all relevant laws.
  2.  is not illegal, fraudulent, obscene, offensive, defamatory, or in any way unsuitable for people under the age of eighteen (18) years.
  3.  is not misleading or deceptive or likely to mislead or deceive.

House Master reserves the right to vet and approve or otherwise all proposed listings provided by you.  

 

4.PERSONAL DATA COLLECTED

House Master collects data you give us voluntarily (for example, an email address). We also collect data automatically ( for example IP address).

4.1 data you give us 

For the registration of an account, you shall provide necessary valid and current information for the purpose of generating a user account (Either as a buyer or a seller), which includes User’s unique login (email address), and a resource password. Resource registration form may require the user to provide more detailed information.

You will be able to use the service even if you do not give this data to us or without creating an account, but some service’s functionality may be limited to you.

4.2 data collected automatically

4.2.1 data about how you found us

House Master collects data about your referring URL (that is, the place on the web where you were when you tapped on our ad)

4.2.2 usage data

We record how you interact with our service. For Example, we log the features, and content you interact with, how often you use the service, how long you are on the service and what sections you use.

4.2.3 transaction data

When you make payments through the service, you need to provide financial account data, to our third-party service providers. We do not collect or store full account data, though we may receive data about the transaction, including time and amount of the transaction.

 

5.CONFIDENTIALITY AND PRIVACY

Each party acknowledges and agrees that House Masters’ confidential information includes (a) the provisions of this agreement; and (b) all information provided by House Master to you under this Agreement, including House Masters’ technical, operational, and commercial information in relation to the supply of Services. Your confidential information is subject to clause four(4) of this agreement.

A party must not disclose the other party’s confidential information to any person except;

  1.  To its professional advisers and its personal on a “need to know” basis, but only if those persons have agreed to keep the confidential information confidential in accordance with the terms of this agreement;
  2.  If required by Law, or any regulatory authority, but only in the minimum extent required to ratify the law or rules of the regulatory authority;

 

6. INTELLECTUAL PROPERTY RIGHTS

You acknowledge and agree that all copyright, trademarks and all intellectual property rights in all material and content supplied as part of the website shall remain at all times vested in us or our licensor. You are permitted to use this material only as expressly authorized by House Master5. All right reserved.  

 

7. COPY RIGHT INFRINGEMENT

If you are a holder of intellectual property rights or a person authorized to act in the name of a holder of intellectual property rights, and you reasonably believe that information which is posted in this resource someway infringes your intellectual property rights of a person, in whose name you act, you may provide notification to the administrator requiring to delete such material. In this regard you shall warrant that your appeal has basis, and you act in good faith according to law.

 

8. LIMITATION LIABILITY

HOUSE MASTER WILL USE REASONABLE ENDEAVORS TO VERIFY THE ACCURACY OF ANY INFORMATION WE PLACE ON THE WEBSITE, WE MAKE NO WARRANTIES, WHETHER EXPRESS OR IMPLIED IN RELATION TO ITS ACCURACY.

HOUSE MASTER DOES NOT GUARANTEE, REPRESENT OR WARRANT THAT THE SERVICES WILL BE COMPLETE OR FREE FROM ALL VIRUSES, DEFECTS OR ERRORS. YOU ACKNOWLEDGE AND AGREE THAT THE EXISTENCE OF ANY DEFECTS OR ERRORS IN A SERVICE DOES NOT CONSTITUTE A BREACH OF ANY AGREEMENT BETWEEN YOU AND HOUSE MASTER COMPANY LTD.  MANAGEMENT HAS HOWEVER PUT MEASURES IN PLACE SHOULD ANY OF THIS OCCUR IN FUTURE.

 

9. CHARGES

Charges are based on specific services required from house master. There are basic charges that is required from agents and property owners prior to listing their properties. There are other packages you can purchase to boost your post or listing. You agree and accept all charges House Master’s services comes with. These charges are however not refundable. Property owner’s or developer’s who wish to employ the services of House Master in the sale or leasing of their property can contact management via email Housemastermanagement@gmail.com   

 

10. INDEMNITY

You agree to indemnify House Master. House as well as its officers, directors, employees, agents, from and against all losses, expenses, damages and costs, including attorney’s fees, resulting from any violation of this Terms and Conditions (including negligent or wrongful conduct).

 

11. THIRD PARTY LINKS

In an attempt to provide increased value to our users, we may provide links to other websites or resources. You acknowledge and agree that we are not responsible or liable, directly or indirectly, for the privacy practices of the content (including mis-representative or defamatory content) of such website.

 

12. LAW

This agreement will be exclusively governed by and construed in accordance with the laws of Ghana whose courts will have exclusive jurisdiction in any dispute, save that we have the right at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
